Terms

These terms cover every website and hosting service you buy from Upstrike, a brand of Equity Capital LLC, 41877 Enterprise Cir N, Temecula, CA 92590 (“Upstrike”, “we”, “us”). By checking out you agree to them.

1. What you're buying

A custom website built to the package you choose at checkout: One-Page ($997), Multi-Page ($1,997) or E-commerce Store ($7,997). What each package includes is listed on our pricing page at the time you order.

2. Payment

At checkout your card is authorized for the full package price; the payment is captured when we confirm your order. Once captured, the package is paid in full. Prices are in US dollars and include everything listed for your package; your domain name and any third-party platform fees (for example a store platform subscription) are paid by you directly.

3. The 24-hour delivery window

Your 24 hours start when we receive your completed project questionnaire together with your logo and photos (or your go-ahead to proceed without them). If we need something from you to finish, the clock pauses until we have it. Delays caused by third parties outside our control — for example domain registrars, DNS propagation or your hosting provider — don't count against the window.

The 24-hour window is our delivery target, not a guarantee. If delivery takes longer, your order, its price and these terms stay the same, and a longer delivery time is not grounds for a refund, discount, credit or cancellation.

4. Content

You confirm you have the right to use everything you send us — text, logos, photos and product information — and that it doesn't infringe anyone else's rights. We write your page copy from your questionnaire; you're responsible for checking that what your site says about your business is accurate.

5. Revisions

Your package includes the number of revision rounds listed on the pricing page, used after your site goes live. A revision round is one consolidated list of changes to the agreed scope. New pages, features or a change of direction beyond your package are quoted separately before any work starts.

6. Ownership

Once your payment has cleared, the website we build for you is yours, including its source files. Your domain stays registered in your name. Third-party components (such as fonts, licensed photography or a store platform) remain subject to their own licenses. We may show your site in our portfolio unless you ask us not to.

7. Launch options and hosting

You choose at checkout how your site launches: on Upstrike Hosting, set up on your own hosting, or delivered as files. Setup on your own host and file delivery are included in your package.

Upstrike Hosting is $97/month. Your first month is included in your package; after that it's charged to the card used at checkout one month after your order date, and monthly from then until you cancel. You can cancel any time by emailing support@upstrike.co; cancelling stops future charges, and the current month runs to the end of its period. When you leave, we'll send you your site's files.

9. Liability

We build every site with care, but we can't guarantee particular search rankings, traffic or sales. To the extent the law allows, our total liability for any claim is limited to the amount you paid us for the service the claim relates to, and we aren't liable for indirect or consequential losses.

10. General

These terms are governed by the laws of the State of California. If any part is found unenforceable, the rest still applies. We may update these terms; the version on this page when you check out is the one that applies to your order. Questions about these terms: support@upstrike.co.
